In today's video I'm going to be utilizing my licensing and certifications as a scan-specific
3
behavioral analyst to be able to break down the non-verbal communication
4
of a certain Don Light who was charged with intimidating jurors regarding the Clancy case.
5
More on that in just a second, let's go ahead and roll this intro.

The Clancy trial now has been going on for over six
7
weeks with the current deliberations between the jurors being problematic to say the least.
8
There have been multiple times now where they have not been able to agree on a verdict
9
and so there is now the looming threat of a hung jury and possibly even a mistrial.
10
complications beyond that of finding people for a new jury set
11
that don't already know everything about this case
12
or feel like they know everything about this case and already have formed an opinion.

It's a mess to be sure.

In today's video we're going to be breaking down the body language of somebody who has overstepped the bounds
15
so to speak of where the observers people
16
that are just looking at the case from a distance viewers
17
hobbyists what have you have now stepped into the realm of legalities
18
and difficulties around that
19
so we're going be looking at her nonverbal communication to decipher is this something
20
that is a regrettable decision for her or is this something
21
that she stands by and is it highlighting a bigger ordeal
22
throughout this i will be utilizing my system here
23
which is a logitech editing hub coupled with a huyan artist's tablet i use
24
that for slow motion replays live annotations what have you like
25
that so hopefully it'll make it a little bit more consumable to you along with
26
that i'll be relying on my certifications and licensing in the SCANS system and the FACS systems.

For those of you that do not know what those are, SCANS is the concept of six-channel analysis system.

That's what it stands for.

It's a behavioral analysis approach and methodology that holds to the fact that human communication flows through six channels,
30
both nonverbal and verbal, and it's only when you take all of those into consideration that you could have the utmost accuracy.

FACS is the facial action coding system which was pioneered by Dr. Paul Ekman.

He went through and mapped all 43 of the muscles across the human face
33
and related them to the emotions that they are tied to.
34
And this goes through degrees of movement and which ones mean which and whatnot.

There's a lot of specificity in that.

So I'll be utilizing those systems predominantly while going through this.

Within those systems, a portion of it is a baseline building
38
which is where you gather a person's behavior before anything weighty is being directed towards them.

It's so you can see what what their behavior patterns are,

while they're more relaxed and less stressed so that you can compare those patterns later on to spikes from that baseline, both positive and negative.

A positive spike is a sudden burst of activity and a negative spike is a sudden freezing of activity.

Utilizing this entire system will help add more accuracy to the read itself, to the analysis itself.

With this specific video, the baseline building options are limited to say the least.

So I'll be utilizing the universalities of body language, which there are few, and then I will be utilizing the universality of facial expressions, which there are more of.

And we'll be combining those, hopefully also, with some of the idiosyncrasies that she does present here to add as accurate of a nonverbal representation.

What her psychology is actually doing in the background as opposed to what she might be wanting to portray to everybody around.

And then we'll wrap up at the very, very end.

I think that that honestly is, that's more than enough talking from me.

Let's go ahead and start into the analysis portion of things.

Obviously, this is just going to continually kind of stream on forward.

So throughout this, this is the closest area region portion

that we can kind of gain a baseline understanding of how light here behaves.

This is circumstantial.

We don't get to really see her not being pressured by something.

So this is still, she's already under some pressure.

She's standing up in front of the court and whatnot.

So we're working with some muddy waters to begin with.

However, what we're able to see is kind of how she responds to various stimuli.

In this case, it's obviously going to be verbal stimuli.

They're talking to her and she's going to react to that.

She's not going to say a lot here.

In fact, I don't think she says anything throughout the entirety of this hearing.

It's not too long of a hearing.

We're going to watch the entirety of it and talk about the body language through it.

Something that I've noticed is that she seems to be more communicative with her eyes.

There will be eyebrow flashes and squints and blinks and acknowledgements through her eyes.

However, there's another portion here, which bear with me as I'm going through this

because I'm still learning this system and there's some quirks that I need to work out with this,

but I'm gonna try to scroll back down through here and show you kind of where she has a response,

a fairly negative response to one of the accusations being directed towards her.

So if we look down here at the screen here, she's about to hear it and you could see it come across her face there.

And so you see her eyebrows drawing together.

This is a foreign activation.

When you see the eyebrows being drawn together and kind of lowered there, that's activation in through here, brow lowers.

And those are common throughout a number of different emotional states.

So the key is to look at the rest of the face as well to gain that context.

The brow lowering itself can be seen in anger.

It can be seen in confusion.

It can be seen in frustration, outrage.

There's a slew of different emotional states that can go into that.

And so what's important to note is the lower half of it.

One, she has a prolonged eye blink.

That prolonged eye blink, anything that lasts longer than an average blink, which is less than a quarter of a second, would be considered an eye blocking gesture.

What that eye blocking gesture, again, means relies heavily on the context as to what's going on.

So with the system that I use, there's two different methods that we're kind of working with within the scan system itself.

One is called the 327 method.

That's where it has to be three pins across two different channels three two within seven seconds of a stimulus.

That could be verbal at any form of external or intrinsic stimulus within seven seconds of that.

And if you see that cluster three pins across two channels within seven seconds, that's enough of a red flag to break the threshold.

Before that, it just kind of counts as like, okay, there were some interesting behavioral quirks, but it's not enough to be able to be like, hey, we need to focus back in here and talk to this person.

They're possibly manipulating what's being said here or presented here on some level.

I think what she's communicating with her nonverbal communication here, considering the rest of the face, is she wants to display that she finds that area outrageous.

Along with that, we're seeing that she puts on her glasses.

She obviously needs them to see, and then she looks and she takes them off pretty quickly here.

And so with that movement, I think that kind of can indicate to us that she's been encouraged to not have her glasses on.

And the reason that that's important to make note of is

because then sometimes you might be able to rely on the fact that we know she needs glasses, that she's had to take them off, she's not wearing contacts, that might affect some of her eye behaviors,

which she will have some eye behaviors in this.

And so we'll have to keep in mind, there's the possibility that some of what we're seeing could be explained away by her not having her glasses on.

We'll have to look at the contexts of what's going on with that.

Back around to the other method that I was talking about that I'm kind of functioning through here.

It's also the ABCs, which is the account, the baseline and the context.

Those three are extremely important to utilize in an analysis like this for accuracy.

So within this account, she's obviously there to answer for this charge that's being presented with her intimidating a juror.

And then the baseline, we've kind of been able to see she's not going to speak a lot.

We kind of saw how her face rests and lies and how she responds to questions.

And then the context itself is what's going on the environment, external influences, people, thoughts, things like that.

That's the context.

So if we're, if we see something and it can't be explained away by either the account, the baseline or the context.

Coupling that with the 327, you've got a major red flag.

There is the distinct heavy, heavy possibility.

You can't ever be 100%, but 90 plus percent possibility that credibility should be questioned there, whether or not she's actually being authentic or telling the truth.

Let's continue on forward.

that may be on her iCloud account in relation to this incident.

I'm going to go ahead and pause here and make note of a couple of things that have stayed consistent here.

Again, she tends to interact more heavily with the upper half of her face that that's the more mobile portion of things.

When there's something that's brought up unexpected, you could see her raise her eyebrows, widen her eyes, like that area of her face is where she's communicating most.

And so it might also be one of the areas that could be most revealing.

However, something that you have to be careful with in

that is that just

because somebody communicates most with a certain region of their face does not mean that they're not aware of that.

She could, in fact, be aware that she does communicate most through her eyes

and so she's more likely to be able to control what's going on through there.

So her eyes might not, in fact, be the windows to her soul in this specific case.

Something else that she is doing regularly, though, I do find interesting and I kind of can see some of the psychological back and forth that's happening here.

You see her eyes doing regular movements.

She's thinking a lot.

Whenever you see somebody's eyes moving around a lot and some frequent blinks and things like that, that usually indicates a level of increased psychological processing.

So she's, her brain's running pretty fast at this point, but what she's trying to portray with the rest of her nonverbal communication is this confident, relaxed state.

And I think she's trying to show that she doesn't have anything that she's worried about here.

And the reason that I'm leaning towards

that being her mindset of what she's trying to portray here is

because of a specific cluster of body language

that she's trying to portray here that happens

when people are trying to show that they're not feeling overtly threatened by something

or they're feeling confident in an area and perhaps at least quizzical, sometimes bored, something along those lines, and it'll come out through this.

And it's this look of where you expose your neck and kind of tilt your head, and that is usually belaying of the mindset of somebody being more confident,

feeling like they're less at risk at the time.

When you see somebody becoming defensive, their body language tends to close up, tighten up, and do some self-preservation motions in there.

So your abdominal area is full of very important things.

So sometimes you'll see hugs or braces and whatnot around on that area.

But then also in your neck here, it's a very vital, rich area as well.

You've got all sorts of nerves and your spinal cord and veins, and it's very important, right?

And so if a person's feeling defensive, it's their body's natural response to protect that area.

So you'll see turtling.

If you then kind of take that pattern and you flip it, you can see the other side of things where they're feeling confident and so they'll expose certain areas of them.

This is not necessarily a universal.

It is something that I have seen repeatedly as a pattern, as well as other nonverbal analysts have seen this pattern come up regularly, but there has not been enough scientific,

we need to get down to some control groups, and do a test group, and then do some extraneous testing outside of that.

That hasn't been able to be fully done as of yet.

It's merely pattern detection at this point.

So we're seeing that in there.

It is pushing me towards believing that she's trying to convey confidence almost not full cockiness, but I'm not at risk here, and I want to show that I'm relaxed and I'm not at risk,

so neck's coming out there, and that head tilt is coming in there, which is interesting, because like I said, her eyes are showing that her mind's racing, her body is showing that she's trying to,

you know, not portray herself as such, and in this case, I would be more likely to follow what the eyes are saying.

I don't think that she's managing all of it well, which is I think her eyes are revealing the truth of things, a little bit of stress, a little bit of panic, a lot of psychological processing,

and her body is something that she's trying to portray as the front.

state police who were involved in the surveillance as well as the security during the Lindsay Clancy case.

Something that I want to point out, it's not implicative of anything right now, but non-verbally speaking, what Light's doing is a very common unlistening cluster.

It's the tilting of the head, oftentimes with the gaze not being directed in a specific area, but more so in a generalized space,

so to speak, and it allows them to audio process a little bit more.

We're seeing that very clearly here down on the screen.

You can see she's got her head lightly tilted here.

This area here is more exposed.

And so she's probably listening through this ear here.

And that, again, that will come up regularly.

Some people try to relate that to some form of deceit

or they're trying to plan out a lie or something like that.

That's not the case.

It is very commonly seen in people who are trying to process audio information to break gaze

and tilt head in a way that allows them to take in sound even more subconsciously.

Called by court officers for an individual who may have been filming potential jurors in the parking lot.

Officers responded to the employee parking lot where there was a restricted area,

and they found a blue Toyota parked in the back of the parking lot, backed in, facing the restricted area that was blocked off.

They did make contact with the person inside that vehicle.

She was identified as the defendant, dawn light before you.

When officers spoke with her, they asked her if she was filming.

It's interesting as this timeline of events that's being presented here, as it's being presented, I'm obviously watching light throughout this.

And there's an area through this as she's saying, backed into an area.

And you can look down here at the screen.

She does a little teeny tiny nod in there of like, yep, that's correct.

And then as it's going through and it's getting to the made contact area, you see this expression here.

The narrowing of the eyes and the light activation, you can see it down here, right?

If you watch her bottom lip there, you can see mild activation upwards and that chin boss activation usually is pushing into what's called a mouth shrug.

And a mouth shrug is the facial equivalent, more or less, to a shoulder shrug.

Now with the narrowing of the eyes and that mouth shrug in there, to me, that's letting me know that light does not fully agree with that.

The narrowing of the eyes, that's suspicion, that's scorn, that's frustration.

So seeing that coupled with the, I think that she finds that specific timeline or narrative questionable from her perspective.

So I would be curious to know what causes this little cluster down here that we're seeing where she's listening, she has that suspicion point, does a blink, looks down,

and then it continues on.

She wipes from there.

It's just more information to be able to make note of as we're going through.

When officers spoke with her, they asked her if she was filming or taking pictures of anyone in the parking lot.

She was adamant that she was not.

She stated that she was waiting to see if Lindsay Clancy would come out of the building.

I'll rewind it now where she's talking about the officers kind of interacting with her where the attorney is talking about that.

You could see on Light's face, it's developed further.

It's no longer a mouth shrug of uncertainty and some suspicion in there of like, I don't think that that's quite right.

Now we're seeing, we're seeing heavy, heavy activation here in the corners of her nose, which is indicative commonly of disgust.

And then we're seeing the same cluster up here at the top with her eyebrows being drawn together and her eyes narrowing.

That disgust is an amplification.

No longer is it just the mouth shrug of perhaps, I don't know about that.

It's now, not only do I not know about that, I also have a level of contention against that.

That's kind of what she's communicating with her nonverbal communication there.

Then we have this guard come in here, down here on the screen, and it's difficult to see what he's saying, but her response to that,

she obviously leans in, she's listening, she raises her eyebrows.

Again, that eyebrow flash, that eyebrow raise is a very common social interaction when a person's like wanting to listen.

They'll be like, what was that kind of thing?

You'll see that come up.

But also when they're trying to make a point of like, you need to do this.

Eyebrows will come up.

The eyebrow flash like that is a very social nonverbal display from the face.

So she does that when he comes over and then the only thing that she seems to do says, I think she says down here,

a gotcha of a course or something along those lines.

But the only thing that's really changed after her smile, she tunes back in and she has her hand out of her pocket.

That's the biggest difference that I'm seeing there.

So I wonder what's going on with that interaction that caused that to happen there.

And that couples with this take your glasses off aspect

that we saw earlier on where she just put them on

and immediately took them off after seeing somebody off to the side.

So I'm wondering how heavily coached she is feeling at this moment to behave in a specific way

while interacting in this situation due to all of these corrections.

The reason that that's important for me to keep in mind is

that that adds an extra layer of cognitive processing over what her nonverbal communication might actually present

because she's actively seemingly trying to meter it as inspired by external forces.

That adds some complications to it, but with that, when a person is actively trying to meter all of their nonverbal communication, unless they're a very versed liar

or perhaps an actor who has been able to get into a certain character or something along those lines,

it's very difficult for a person to manage all of their nonverbal communication all at the same time without letting something slip.

Again, if it can be explained away by the account, the baseline, or the context, then you can't hold too much weight to it.

There has to be more.

It's extremely, extremely difficult, if not impossible at this point in our understanding of nonverbal communication to have a black

and white 100% or 0% kind of answer.

Just wanted to add all of that for clarity.

We're going to continue on through this.

Through her phone, at her photographs, she did consent.

She gave them the phone in which they began to look through her photos.

At that time, they did not see any videos or photographs of any individuals in the parking lot.

Talking about the photos, we'll rewind here just a second.

She's saying officers asked for the phone, gave phone, all of that.

And you could see again, nonverbal nod in there.

She's like, yep, that is what the narrative was.

And then going through and the officers didn't see any photos initially.

But then it's after that, that we see a spike from her baseline.

She, you know, she's been maintaining fairly steady eye contact and less interrupted by an external influence.

And now we're seeing, we've gotten to this point of the photos, didn't see anything initially.

And if you watch here, she goes from holding fairly stationary to a full tilt, reposturing, her legs move, her body moves,

and she looks into a different direction and that little pop, there are multiple channels that are in there and it happens right after a specific stimulus.

It's enough of like, okay, I see something.

I should pay attention here.

That lets me know that this photos aspect

and what was initially apparent is causing her some discomfort due to all of the lighting up of her nonverbal communication.

Whenever you see that pop out like that.

Something extra psychological has happened with that.

And oftentimes in cases like this, it will be something more implicative in this scenario.

If it wasn't, there wouldn't be a need for a psychological response that heavily.

Now, as to what that implication actually is, is where the details are for this.

It's around the jurors and all of that.

But you can't say that just from the body language.

You could just be like, okay, I see that she's anxious about this.

We need to figure out why.

But she is without a doubt.

This has affected her psychologically, as you can see through that no movement to sudden at all movements everywhere, rocking, moving, looking, everything like that.

It all of it pops up, lights up right there.

So that's just something that I wanted to also call light to.

These photos and the concept of it causes her stress.

She stated she did not know how to do that.

She let troopers get the phone and go through her deleted photos.

in the deleted folders file, they did locate a video of a number of individuals coming out of the courthouse building from the vantage point

that she was located in.

Interesting.

So now we're talking about the deleted photos.

She does a pretty substantial look down.

Maybe that is a chin tucking behavior, which that would stray into that defensiveness that I mentioned earlier.

Vulnerable tuck when you're feeling defensive, stressed, or threatened on some level.

So maybe that's what's going on.

She could also just be looking down.

Now, what kind of pushes me away from her just looking down at

that instance is then she also has a substantial facial manipulator.

And the manipulator that I'm referring to in this is not like a person who manipulates a person.

A manipulator is when one portion of a human body manipulates either another portion of the body.

It can be clothing as well, jewelry.

It's a manipulation, object to object manipulation. So manipulator.

And she has it down here, as you can see.

And when it comes up, she has the one and only pretty substantial rubbing of her eye.

Now, that being said, she also has a blink before that.

You could see right below, she has a couple blinks in there, blink, blink, blink.

And then she reaches up and rubs her eye and then that's kind of the end of it.

Maybe it was a mechanical need.

Her eye itched a little bit and she just needed to rub her eye or something along those lines.

She doesn't do it anywhere else.

So it is still a pop.

It could possibly be explained by environment.

It wouldn't necessarily hang everything on that, but it was across a couple of different channels

that we're seeing these movements

so it is still a pin a point of interest a red flag you want to pay attention to it

if it's in a situation that enables it

or is requiring of it this would be one of those areas to circle back around those are all aspects

that we're seeing so far let's continue on through from the vantage point

that she was located in state police then spoke with court officers who were then able to confirm

that those individuals in those videos were the jurors in regards to the Lindsay Clancy trial.

At that point, she was taken.

Gives us more context right there.

Those were the jurors from the Lindsay Clancy trial.

Now, as she's saying that, obviously, we're seeing a huge macro shake no, which the no shakes, the nods, the head movements are culturally based.

She's from the U.S and in the U.S., the verticals are yeses and the horizontals are noes.

So we're seeing that no in there makes sense for everybody in this specific culture

that she's in and some other ones

that it's not for all of the globe that's where baseline

culture context all of that's very important to be able to keep mind of hers is a no

and then on top of that as she's saying

that you can see if you watch her mouth ever

so slight activation of the corner of her mouth there there's

the possibility of it activating on both sides it's difficult to say

because we're kind of doing a side profile here but seeing

that come in there that would be contempt which is a feeling of moral or intellectual superiority.

And then on top of that, you see the chin raise a little bit more and the head cock a little bit more, which gives us

that clarity from earlier where I was saying this could be

her being like attempting to put on a front of confidence and I'm not feeling attacked by this.

And so I'm doing these sorts of displays, seeing it in an area like this too, coupled with that other bit of nonverbal clustering that gives us that understanding.

That is what was happening earlier on.

That's how she represents that she doesn't agree with and she feels unaffronted by something.

She does not feel threatened by it.

Comes out that way.

She disagreed with that mindset of these were photos of the jurors.

And that makes sense with the account that she'll have here in a second.

Into custody.

And those are essentially the facts.

Judge, the Commonwealth is asking for $50,000 cash bail based on the facts of this case. $50,000 is a,

you know, that's a chunk of change there

and as that's being brought up here you can see just ever

so slight activation here underneath the eyes I'll show you

and that's called the eye tensing you can see it there just

so so slight again that that's an indicator of she does not agree with

that there's some scorn or suspicion there's confrontation regarding

that specific side of things which makes sense it's fifty thousand dollars that's a lot

so it would make sense to see her have

that sort of emotional response to it it's definitely being communicated again through her eyes.

So with that, perhaps there's the possibility that she is just

that communicative with her eyes and possibly unaware of how much she does communicate with them.

As well as the investigation that was put through,

officers were able to look at surveillance video from the courthouse where they did see this defendant's car.

She pulls into the parking lot and they are able to track her through the parking lot, through the front of the courthouse,

and then she parks in the back employee lot backs in and is facing the restricted area.

Miss Light's actions yesterday are extreme.

So going through that, obviously, all of the things that I've mentioned before, you've seen as she's trying to compute what's going on with that.

You've seen the eyebrow activation, all of that.

We're going to talk about this expression here that we're having here on the screen.

Very overt lips pressed together upside down, we're doing a partial mouth shrug, you could see that predominantly again through the chin boss.

That's the thing that drives a mouth shrug as opposed to something like an actual crying grief frown.
